REX IMPLANTS, INC. PRODUCT WARRANTY

Rex Implants, Inc. (“Rex Implants”) guarantees its products to be free of manufacturing defects for one (1) year from purchase date. Products thought to have manufacturing defects should not be used and should be reported to Rex Implants for evaluation. Rex Implants will replace any product determined to be defective with equivalent or comparable products. Rex Implants will use its best efforts to provide a replacement or comparable product, but may also elect to refund the purchase price. This warranty is the sole remedy for handling products with manufacturing defects.

Additionally, Rex Implants offers a lifetime warranty program to eligible customers, as outlined herein.

This warranty covers only Rex Implants’ dental implants that have been surgically placed but not restored or which have been placed and restored exclusively with original restorative devices.

Subject to review and approval by Rex Implants, the clinician or distributor submitting a warranty claim will receive replacement implants equivalent or comparable to those originally purchased. Rex Implants reserves the right to deny warranty coverage if the affected product(s) cannot be determined to have been manufactured by Rex Implants.

Eligibility: This lifetime warranty applies exclusively to the original purchaser of the device, intended as the person or organization that acquired the device from Rex Implants, Inc. or a duly authorized distributor. To receive warranty benefits, the treating clinician(s) must meet the following criteria.

  1. Have activated a Lifetime Warranty by creating an account on Rex Implants’ customer portal. Registration must be performed prior to the date of surgical placement of the implant claimed.
  2. Submit a properly completed Customer Event Report (Rex Implants Complaint Form) to Rex Implants and return the pre-sterilized device(s) to the distributor. Device(s) must be clearly labeled and packaged in a manner that prevents loss and/or damage during shipment.
  3. Have used the device(s) and all related surgical instruments, including Piezosurgery® and its related accessories, and restorative devices in accordance with Rex Implants’ prescribed procedures (including the device’s IFU) and in accordance with accepted medical/dental practices.

Rex Implants reserves the right to modify or terminate this warranty program at any time, and will endeavor to provide notice of any material change by sending customer communications by email and/or posting a notice of the modification or update on this website.

Rex Implants may, in its sole discretion, terminate the eligibility of any participant from this Warranty Program, including in the event of suspected abuse or fraud. Such termination shall not affect benefits accruing to the participant prior to effective termination date.

Warranty benefits under this Warranty Program are exclusively for the benefit of the eligible treating clinician(s) only. Patients and other third parties must contact their clinician for coverage. Clinicians and distributors must not charge their customers or patients for in-kind replacement products supplied pursuant to this Warranty Program.

Rex Implants’ benefits under this Warranty Program shall not apply to 1) implants placed in patients with any of the contraindicating conditions outlined in the implant IFU, and 2) implants that are not placed in accordance with the product’s IFU or the guidelines for patient evaluation and selection contained in Rex Implants’ surgical manual. This Warranty Program does not apply to any products that are custom-designed and/or manufactured or modified from an original device design for, by, or at the request or order of a treating clinician, unless the device is specifically designed by Rex Implants for such modification.

This Warranty Program is governed by the laws of Ohio without regard to conflicts of law principles.
